1. Introduction

These Terms and Conditions (“T&C”) constitute a legally binding agreement between you (“Client,” “Shipper,” or “Visitor”) and Hermes Industries Trucking (“Company,” “we,” “our,” or “us”). By accessing this website, submitting a load request, engaging our transportation or logistics services, or communicating with our team, you agree to be bound by these T&C.

The purpose of these T&C is to establish clear legal boundaries governing how visitors and customers interact with our website and services. These terms define the relationship between Hermes Industries Trucking and anyone who uses, accesses, or relies on information provided by this website.

2. Scope of Services

Hermes Industries Trucking provides transportation, freight hauling, logistics support, and related services.
All shipments, quotes, load confirmations, and service agreements are subject to these T&C unless a separate written contract is executed and signed by an authorized corporate representative of Hermes Industries Trucking.

3. Authorized Agreements Only

To protect both the Company and our clients:

  • Only agreements made directly with an authorized corporate representative of Hermes Industries Trucking are valid.

  • Agreements, side deals, or verbal arrangements made with individual drivers, subcontractors, or private operators are not binding and will not be honored.

  • All confirmed rates must be communicated through our dispatch office, official email, or approved platform.

This ensures accuracy, accountability, and safety for all clients and operators.

4. Payment Terms

  1. Preferred Payment Method – COD
    For new accounts and most shipments, Cash on Delivery (COD) or prepaid payment is required as the primary method of payment.

  2. Credit Terms
    Net-10 or Net-30 payment terms may be offered only after completion of a credit application and written approval from an authorized representative.

  3. Late Payments
    Failure to pay invoices on time may result in:

    • Interest of 1.5% per month or the maximum allowed by law

    • Collection actions

    • Suspension of services

  4. Additional Billing
    Accessorial charges including detention, layover, TONU (truck ordered not used), redelivery, lift-gate requests, and waiting time may be added to the final invoice where applicable.

5. Insurance & Liability

Hermes Industries Trucking maintains commercial insurance coverage in the millions, including auto liability, general liability, and cargo insurance, consistent with industry standards and federal regulations.

5.1 Coverage Limits

Coverage applies only within the limits of our active policies. Specific policy details can be provided upon written request.

5.2 Limitations

We are not liable for:

  • Improperly packaged, labeled, or secured freight

  • Delay caused by weather, road closures, mechanical issues, or regulatory compliance requirements

  • Acts of God, vandalism, theft, rioting, or unforeseen events beyond reasonable control

  • Special, indirect, punitive, or consequential damages

5.3 Claims

All claims related to loss, damage, or delay must be:

  • Submitted in writing

  • Provided within 30 days of delivery or discovery

  • Supported with appropriate documentation

Claims will be handled in accordance with federal guidelines (49 CFR Part 370).

6. Client Responsibilities

Clients utilizing Hermes Industries Trucking agree to:

  • Provide accurate descriptions of cargo, including weight, dimensions, and material type

  • Ensure freight is properly packaged, palletized, crated, or secured

  • Comply with all DOT, FMCSA, and hazardous materials regulations

  • Provide safe and legal access for pickup and delivery

  • Pay all agreed-upon charges and any additional fees incurred due to misinformation, delays, or changes to the shipment

Failure to meet these responsibilities may result in service refusal or additional charges.

7. Rates & Service Conditions

All quotes are based on information provided at the time of booking. Any changes may result in adjusted rates.

Hermes Industries Trucking does not guarantee delivery times unless explicitly stated in writing. Delivery windows are estimates subject to:

  • Traffic conditions

  • Weather

  • Road restrictions

  • Equipment limitations

  • Regulatory driver hours-of-service requirements

We reserve the right to decline or cancel loads that are unsafe, overweight, misrepresented, or illegal.

8. Website Usage & Visitor Obligations

By accessing this site, visitors agree not to:

  • Misuse any content, images, or materials

  • Copy or replicate site materials without permission
